Service availability:

We strive to maintain the service available 24/7, but do not guarantee 100% availability. The service is provided "AS IS" and "AS AVAILABLE" without warranty of any kind.

Scope of Mobile License:

SENSOTED grants you a non-transferable, non-exclusive license to use the MetaDevProfile mobile application on devices you own or control, subject to the terms of the respective app stores (Apple App Store, Google Play Store).

Mobile Application Restrictions:

Mobile License Termination:

This license terminates automatically if you breach these terms. Upon termination, you must cease all use and delete the application from your devices.

Maintenance and support:

SENSOTED is solely responsible for maintaining and supporting the mobile application. Apple and Google have no obligation whatsoever to furnish any maintenance or support services.

Claims:

SENSOTED is solely responsible for addressing any claims relating to the mobile application, including product liability claims, claims of non-compliance with legal or regulatory requirements, and claims under consumer or data protection law.

Third-party beneficiary:

Apple and its subsidiaries are third-party beneficiaries of these terms. Upon your acceptance, Apple will have the right to enforce these terms against you as a third-party beneficiary.

Free Trial:

15-day free trial available for Pro subscription.

Subscription Duration:

Monthly subscription: 1 month renewable - Annual subscription: 12 months renewable.

Payment:

On the web, payments are processed by Stripe. On mobile, subscriptions are purchased through the Apple App Store or Google Play (managed by RevenueCat) and subject to those stores' terms. Displayed prices include applicable VAT.

Renewal:

Subscriptions renew automatically at the end of each period, at the current price, unless cancelled at least 24 hours before the end of the current period.

Institution Subscription Features:

• Institutions subscribe with monthly per-seat billing
• Each practitioner added automatically increments the subscription
• Practitioners have full access to Pro features
• Group system for sharing patients between practitioners
• Administrators can manage practitioners and groups

Practitioner Management:

Institution administrators can create practitioner accounts, manage patient sharing groups, approve devices, and track the subscription. Each practitioner addition or removal automatically adjusts billing.

Practitioner Removal:

When a practitioner is removed from the institution, the seat count is automatically reduced and billing adjusted pro-rata. Institution data and patient files remain secure and accessible to authorized personnel.

Monthly subscription:

No commitment, cancellable at any time.

Annual subscription:

15-day right of withdrawal.

Cancellation procedure:

On the web, from your billing area. On mobile, from the subscription settings of your Apple or Google Play account. You can also contact us at legal@metadevprofile.com.

Effective date:

Cancellation takes effect at the end of the current billing period.

Third-Party Responsibility:

You use these external services at your own risk. SENSOTED is not responsible for the availability, content, or performance of third-party services. You agree to comply with the terms of service of each third-party provider.

Service Availability:

External services may not be available in all countries or languages. SENSOTED reserves the right to change, suspend, or discontinue integration with any third-party service without notice.

User responsibility:

You are responsible for the quality, legality and confidentiality of the data you store on MetaDevProfile.

Data security:

We encrypt all data. Sensitive information is encrypted with AES-256-CBC.

Backup:

While we perform regular backups, we recommend keeping your own backup copies.

Types of Technical Data:

• Device information (model, operating system, version)
• Application usage data and performance metrics
• Error logs and crash reports
• Network connectivity information
• Feature usage statistics
• Session duration and frequency

Consent and Usage:

By using MetaDevProfile, you consent to the collection of technical data. This information is used in aggregate form and does not personally identify you. We use this data to improve service quality, fix bugs, and enhance user experience.

Data Retention:

Technical data is retained for a maximum of 24 months and is automatically deleted thereafter unless required for ongoing service provision or legal compliance.

MetaDevProfile service:

SENSOTED owns all intellectual property rights to MetaDevProfile.

Usage license:

We grant you a non-exclusive and non-transferable license to use MetaDevProfile.

Your data:

You retain all rights to the data you create and store on MetaDevProfile.

Trademark:

MetaDevProfile is a registered trademark of SENSOTED.

Force majeure:

SENSOTED cannot be held responsible in case of force majeure.

Notification:

You will be informed of important changes by email or notification in the application.

Termination by user:

You can terminate your account at any time according to the terms described in the cancellation policy.

Termination by SENSOTED:

We may suspend or terminate your account in case of violation of terms of use.

Data after termination:

Your data will be deleted 30 days after termination, unless otherwise required by law.

Competent jurisdiction:

Any dispute falls under the exclusive jurisdiction of the courts of Aix-en-Provence.

Consumer rights:

This clause does not affect consumer rights.

European Union Users:

If you are a citizen of any European Union country, Switzerland, Norway, or Iceland, disputes shall be governed by the laws and courts of your usual place of residence.

Other International Users:

For users in other countries, French law applies, but consumer protection laws of your country of residence may also apply where they provide greater protection.

Export Prohibitions:

MetaDevProfile may not be exported or re-exported to any embargoed countries or to anyone on government restricted lists. By using MetaDevProfile, you represent that you are not located in such countries or on such lists.

Government Use:

MetaDevProfile and related documentation are "Commercial Items" consisting of "Commercial Computer Software" and "Commercial Computer Software Documentation." If acquired by or on behalf of a government entity, these items are licensed with only those rights granted to other end users.
